2. Warning and Risk Assumption

Warning: Batteries, including rechargeable ones, must be handled with care. Improper usage, storage, alteration, or handling of batteries may result in damage, fire, or explosion, which can cause serious personal injury. The Company disclaims any liability for damages resulting from mishandling or misuse of its products. By purchasing any product from Battery Gurus, you acknowledge and assume all risks associated with the use of the product.

3. Battery Usage and Safety

General Safety:

• Batteries can cause damage such as leaking, fire, or explosion if misused.
• Always adhere to the manufacturer’s instructions and applicable laws and regulations.

Charging Safety:

• Charge batteries only in a fireproof container.
• Charge in an isolated area, away from flammable materials including wood, carpet, and paper.
• Do not leave the battery unattended while charging. Monitor the charging process continuously.

Handling and Storage:

• Keep batteries and battery packs out of reach of children.
• Do not use batteries that are damaged, peeling, punctured, dented, or altered.
• Ensure batteries are kept clean and dry, and store them in a protective enclosure.
• Avoid exposing batteries to moisture, direct sunlight, or extreme temperatures.

Emergency Procedures:

• In the event of battery leakage and contact with eyes, do not rub the eye. Rinse immediately with water and seek medical attention. Untreated battery fluid can cause serious damage.

4. Professional Inspection

If you are constructing a battery pack or charger, have it inspected by a licensed electrician or a certified battery professional to ensure safety and compliance with relevant standards.

5. Disclaimer of Warranties and Limitation of Liability

Disclaimer of Warranties:

• The Company makes no warranties or representations regarding the products except as expressly provided herein. All products are provided "as is" without any warranty of any kind.

Limitation of Liability:

• To the fullest extent permitted by law, Battery Gurus shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of its products, even if advised of the possibility of such damages.

6. Indemnification

You agree to indemnify, defend, and hold harmless Battery Gurus, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use or misuse of our products.

7. Governing Law and Dispute Resolution

Governing Law:

• These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

Dispute Resolution:

• Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in Hayward, California, in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English.

8. Amendments

The Company reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the products following any changes constitutes your acceptance of the revised Terms.
